Fighting [The Prohibition of Bloodshed]
It was narrated that 'Amr bin Ghalib
said:
"Aishah said: 'Do you not know
that the Messenger of Allah [SAW] said: It is not permissible to shed the blood
of a Muslim, except a man who committed adultery after being married, or one
who reverted to Kufr after becoming Muslim, or a life for
a life.'"
أَخْبَرَنَا
عَمْرُو بْنُ عَلِيٍّ، قَالَ حَدَّثَنَا يَحْيَى، قَالَ حَدَّثَنَا سُفْيَانُ،
قَالَ حَدَّثَنَا أَبُو إِسْحَاقَ، عَنْ عَمْرِو بْنِ غَالِبٍ، قَالَ قَالَتْ
عَائِشَةُ أَمَا عَلِمْتَ أَنَّ رَسُولَ اللَّهِ صلى الله عليه وسلم قَالَ "
لاَ يَحِلُّ دَمُ امْرِئٍ مُسْلِمٍ إِلاَّ رَجُلٌ زَنَى بَعْدَ إِحْصَانِهِ أَوْ
كَفَرَ بَعْدَ إِسْلاَمِهِ أَوِ النَّفْسُ بِالنَّفْسِ " . وَقَّفَهُ
زُهَيْرٌ .

three cases: a life for a life, a
man who commits adultery after being married.'"

هِلاَلُ بْنُ الْعَلاَءِ، قَالَ حَدَّثَنَا حُسَيْنٌ، قَالَ حَدَّثَنَا زُهَيْرٌ،
قَالَ حَدَّثَنَا أَبُو إِسْحَاقَ، عَنْ عَمْرِو بْنِ غَالِبٍ، قَالَ قَالَتْ
عَائِشَةُ يَا عَمَّارُ أَمَا إِنَّكَ تَعْلَمُ أَنَّهُ لاَ يَحِلُّ دَمُ امْرِئٍ
إِلاَّ ثَلاَثَةٌ النَّفْسُ بِالنَّفْسِ أَوْ رَجُلٌ زَنَى بَعْدَ مَا أُحْصِنَ
وَسَاقَ الْحَدِيثَ .

'Umra
It was narrated that Zaid bin Thabit
said:
The Messenger of Allah said:
"Whoever gives a life-long gift, it belongs to the one
to whom he gave it, both during his life and after his
death. And do not give things on the basis of Ruqba, for whoever is given
something on the basis of Ruqba, it becomes part of his estate."
أَخْبَرَنَا
مُحَمَّدُ بْنُ عُبَيْدِ اللَّهِ بْنِ يَزِيدَ بْنِ إِبْرَاهِيمَ، قَالَ
أَخْبَرَنِي أَبِي أَنَّهُ، عَرَضَ عَلَىَّ مَعْقِلٌ عَنْ عَمْرِو بْنِ دِينَارٍ،
عَنْ حُجْرٍ الْمَدَرِيِّ، عَنْ زَيْدِ بْنِ ثَابِتٍ، قَالَ قَالَ رَسُولُ اللَّهِ
صلى الله عليه وسلم " مَنْ أَعْمَرَ شَيْئًا
فَهُوَ لِمُعْمَرِهِ مَحْيَاهُ وَمَمَاتَهُ وَلاَ تَرْقُبُوا فَمَنْ أَرْقَبَ
شَيْئًا فَهُوَ لِسَبِيلِهِ " .

'Umra
Hisham narrated from Abu Az-Zubair,
from Jabir, that the Messenger of Allah said:
"Hold on to your wealth and do
not give it on the basis of 'Umra. For whoever is given something on the basis
of 'Umra for the rest of his life, it belongs to him for the
rest of his life and after his death."
أَخْبَرَنَا
مُحَمَّدُ بْنُ عَبْدِ الأَعْلَى، قَالَ حَدَّثَنَا خَالِدٌ، عَنْ هِشَامٍ، عَنْ
أَبِي الزُّبَيْرِ، عَنْ جَابِرٍ، أَنَّ رَسُولَ اللَّهِ صلى الله عليه وسلم قَالَ
" امْسِكُوا عَلَيْكُمْ أَمْوَالَكُمْ
وَلاَ تُعْمِرُوهَا فَمَنْ أُعْمِرَ شَيْئًا حَيَاتَهُ فَهُوَ لَهُ حَيَاتَهُ
وَبَعْدَ مَوْتِهِ " .

Narrated Zayd ibn Thabit:
The Prophet (saws) said: If anyone
gives something in life-tenancy, it belongs to the one to
whom it is given, in his life and after his death; and
do not give property to go to the survivor, for if anyone gives something to to
to the survivor, it belongs to him.
حَدَّثَنَا
عَبْدُ اللَّهِ بْنُ مُحَمَّدٍ النُّفَيْلِيُّ، قَالَ قَرَأْتُ عَلَى مَعْقِلٍ
عَنْ عَمْرِو بْنِ دِينَارٍ، عَنْ طَاوُسٍ، عَنْ حُجْرٍ، عَنْ زَيْدِ بْنِ
ثَابِتٍ، قَالَ قَالَ رَسُولُ اللَّهِ صلى الله عليه وسلم "
مَنْ أَعْمَرَ شَيْئًا فَهُوَ لِمُعْمَرِهِ مَحْيَاهُ وَمَمَاتَهُ وَلاَ
تُرْقِبُوا فَمَنْ أَرْقَبَ شَيئًا فَهُوَ سَبِيلُهُ " .
